These Terms constitute a legal agreement between you ("User") and Kumawatpulse Technologies governing your use of the GoAlert travel safety and SOS app for Android. By downloading, installing, or using GoAlert, you accept these Terms in full. Data handling is governed separately by our Privacy Policy; website cookies by our Cookie Policy.

1. Eligibility

• You must be at least 13 years of age.
• Ages 13–18 require parental or guardian consent.
• You must have legal capacity under applicable law.

2. License grant

We grant a limited, non-exclusive, non-transferable, revocable license to install and use GoAlert on a personal Android device solely for personal safety and emergency communication.

3. Prohibited uses

• No stalking, surveilling, harassing, or monitoring any person without their explicit consent.
• No reverse-engineering, decompiling, modifying, or derivative works.
• No unlawful use or violation of applicable law.
• No false-emergency or fraudulent SOS misuse.
• No interference with the app's operation or related systems.

4. Your responsibility

• Configure the app correctly, including accurate emergency contacts.
• Activate tracking and SOS features when needed.
• Maintain battery charge, connectivity, and granted permissions.
• GoAlert is a supplementary safety tool, not a replacement for emergency services (Police: 112, Medical: 108, Women Helpline: 1091 in India).

5. Intellectual property

All IP in GoAlert — code, design, graphics, trademarks — belongs to Kumawatpulse Technologies. Nothing here transfers ownership to you.

6. Disclaimer — provided "as is"

Technology limits you accept: GPS inaccuracy indoors/tunnels/dense areas; push-delivery dependence on Internet and Firebase availability; total failure on battery depletion; third-party interruptions outside our control. GoAlert is NOT a certified life-safety system, medical device, or professional emergency response service.

7. Limitation of liability

To the maximum extent permitted by law, Kumawatpulse Technologies, its directors, officers, employees, and affiliates are not liable for: indirect or consequential damages; failed or delayed notifications (connectivity, Firebase, device issues); injury, death, or property damage from relying on GoAlert as a primary safety measure; data loss from device/app/OS issues; unauthorized third-party access to Internet-transmitted alerts; harm from your failure to activate features, charge the device, or grant permissions; or misuse for non-safety purposes. Where liability cannot be fully limited, it is limited to the fullest extent the law allows.

Indemnification

You indemnify and hold us harmless against claims arising from your use, your breach of these Terms, your breach of third-party rights, or your breach of applicable law.

8. Governing law & international users

These Terms are governed by the laws of the Republic of India, disputes subject to competent courts in Rajasthan, India. International carve-out: where you live, mandatory consumer-protection laws of your home jurisdiction may grant you rights that cannot be waived by contract — nothing here removes those statutory rights, and local courts may hear claims as their law provides.

9. Termination & changes

We may update, suspend, or discontinue GoAlert anytime without prior notice; rights terminate automatically on breach. Material term changes take effect on the new Effective Date below; continued use means acceptance — otherwise uninstall.
